  1. Which data are processed?

We process the following personal data that we receive from you in the course of the business relationship: first and last name, address, e-mail address, digital copy of your identity document, telephone number, date of birth, information about the nature and content of the business relationship. Further, we store any of your transaction data in relation to FIAT, and Crypto Currencies, as well as Token Purchase Transactions. Additionally, we store all the data that we process to forward messages to your Bank52 interaction Portal (MobileAPP, Webpage, CallCenter).

  1. For what purposes and on what legal basis is the data processed?

The data is required to complete or fulfill your contract with us. If you do not provide us with this information, or you do not fully provide it, we may not be able to.

  1. When will my data be deleted?

Your master data and any other personal data will be deleted in principle after termination of the contractual relationship, but at the latest after expiry of all statutory storage requirements. Your transaction data will be deleted within a period of three months after the payment process, unless you have made a written objection. During an ongoing process (e.g., objection, open fees, ongoing interest payments, etc.) your data will not be deleted. Your content / transactional data will be deleted as soon as its processing is no longer required to provide our banking services and/or we are enabled by the statutory storage requirements. – Instead of a deletion, an anonymization of the data can be made.

  1. Who receives my data / Who has access to my data?

Within our company, those jobs or employees receive your data, as needed to fulfill contractual and legal obligations and legitimate interests, (For example, customer service). In addition, we will have your data processors (such as a payment service provider for credit cards, etc.) collect your data as long as they need the data to fulfil their respective performance. All processors are contractually obliged to treat your data confidentially and to process it only as part of the provision of services.

Rights to information

You can ask us for information as to whether and to what extent we process your data.

Right to rectification

You can request the correction or completion of your personal data from us at any time.

Right to cancellation / Right to forget

You may request the deletion of your personal data, provided we do so improperly processing or processing disproportionately in your authorized protective interests intervenes. Please note that there may be reasons for an immediate deletion, e.g. in the case of legally regulated storage requirements.
Right to of restriction processing
You may require us to restrict the processing of your data if:

  • you deny the accuracy of the data for a period of time that allows us to verify the accuracy of the data
  • the processing of the data is illegal, but you reject a deletion and instead demand restriction of data usage,
  • we no longer need the data for the intended purpose, but you still need this data for assertion, exercise or defense of legal rights, or
  • you have objected to the processing of the data

Right to data portability

You may require us to provide you with the information you have entrusted to us for safekeeping in a structured, common and machine-readable-format.

Right to oppose

If we process your data for the purpose of exercising public-interest tasks, for the exercise of official authority, or if we rely on the necessity to safeguard our legitimate interest in processing, you can object to this data processing if there is an overriding interest in protecting your data, and you can contradict the sending of advertising at any time without giving reasons, or use our advertising setup in your Wallet APP and/or your WebPage Settings.

Right of appeal

If you believe that we have violated European data protection laws when processing your data, we ask you to contact us in order to clarify any questions. Of course, you have also the right to contact any European Data Protection Authority, as of 25.5.2018, also with a supervisory authority within the EU, to complain.

  1. Confirmation of identity

If in doubt, we may request additional information to confirm your identity. This is to protect your rights and privacy.

  1. Overburdening usage of rights

If you perceive one of the mentioned rights to be manifestly unfounded of particularly frequent, we may demand a reasonable processing fee or refuse to process your application.

  1. Adaption of this information
